The Mary McCarthy story just took a fascinating turn with the revelation that high powered criminal attorney Ty Cobb has taken on McCarthy as a client.
What is significant about Mr. Cobb is that he defended some of the highest profile criminals in the Clinton Administration including cabinet officers, a White House staffer, and a former Senator:
Represents the chief financial officer of major public company in an SEC investigation of significant restatement and alleged misconduct. (Jeff Skilling?)
Represented the United States Olympic Committee in connection with the DOJ investigation into the Salt Lake City, Utah Olympics.
Represented The Honorable Eli Segal, a former Clinton Cabinet official, in an Independent Counsel investigation resulting in his exoneration and an award of attorney’s fees.
Represented a high ranking White House official in Congressional and DOJ investigations involving the White House Travel Office.
Represented a former U.S. Senator and, separately, a member of the First Lady’s staff in connection with the Congressional and Independent Counsel investigations into “Whitewater.â€
Represented other Cabinet and Cabinet level officials on three separate occasions in DOJ investigations.
Represented a former Commerce Department official and Democratic National Committee official, John Huang, in connection with Congressional and DOJ investigations (and related civil actions) involving campaign finance and the Clinton-Gore campaign of 1996.
If someone would fill in those blank names (too busy this AM) I would appreciate it.
The point is, why does little ole whistleblower Mary McCarthy rate such heavy Democratic party artillery? Especially if she’s not under indictment. Especially if the case hasn’t been referred to the Justice Department.
AJ Strata thinks McCarthy is making a mistake by relying on this particular attorney and I agree. It appears that Mr. Cobb was hired by others – not to defend McCarthy so much (defend her from what?) but to manage information coming out of leaks at the CIA on the case. He can deny, deny, and deny again that she leaked but as Mac points out, she signed a statement admitting wrongdoing.
My post last night on McCarthy pointed out that she may have been simply a facilitator for the press, confirming or denying specific information to keep reporters on track with their stories. But even if she leaked like a sieve and sang like a canary, the question you have to ask is: How has a woman who may not be in any danger at all from prosecution been able to procure the services of a $750 per hour attorney like Ty Cobb whose client list reads like the attendees at a Bill Clinton private Sybaris party?

Prosecuting a leak case is not easy, which is why it happens so rarely. The only sure way is to catch someone red-handed, which almost never happens. There’s a reason polygraphs aren’t admissible in court – they’re unreliable.
According to news reports, she did admit to “having improper contact†with members of the press. This, in and of itself, is not a violation of her non-disclosure agreement (NDA) with the government. However, people in positions like hers with high security clearances are generally prohibited from independent contacts with the press – contacts are supposed to go through the agency’s PR office. This appears to me to be the basis upon which she was fired – not for any actual leaking. Although the CIA probably believes she was a leaker, and the leaker for the black prisons program, there is no way to prove it, so I bet the chances of prosecution are pretty slim at this point. Even if charges are filed, conviction is unlikely.
As for a high-powered attorney like Ty Cobb, he may have to her and offered representation for free or a reduced rate. Or, like Rick said, someone else hired him and is footing the bill. This isn’t all that surprising since the left-wing sees the salivating right-wing blogspere going banana’s over this story. They obviously want to get this story over and done with and get back to Bush-bashing.

You’ve got Porter Goss in there destroying the CIA’s ability to produce objective intel and you’re obsessing about some lawyer, as if it makes a difference who represents whom. It’s another head-scratching side issue so common on conservative blogs. What’s really happening is there’s a war soing on between the intelligence community and Bush. It turns out that CIA agents aren’t really happy with their new role as the players in Bush’s homoerotic torture scenarios. The CIA has long held that torture is counter-productive, and rightly so. They also don’t like the way Bush claimed “bad intelligence” rather than take the heat for his mis-characterizations (lies) about the intelligence he recieved on Iraq. On top of that, Bush’s staff leaks the identity of a valuable NOC to the press, because her husband is not marching in lockstep with the war propaganda campaign. Bush retaliates to dissent within the CIA by sending in Goss, a died in the wool political hack, to purge the agency of Democrats and liberals, as if the CIA is some kind of hotbed of liberalism. Given that this is Cobb’s own partial list of clients, and that there are exactly two named defendants in the list, and the other one “was exonerated,” (according to Cobb’s own information), that’s all that CAN be done.
Put another way, 50% of Cobb’s named clients, above, were convicted.

The point is that Mary McCarthy isn’t nonpartisan. That is the point. We knew already that Libby was a Republican. What is apparent is the concerted effort on the part of Porter Goss to rid the agency of any agents that don’t share his political beliefs. People like him put democracy in more peril than any two-bit muslim terrorist ever could. We don’t really know who leaked the information about the foreign torture prisons. It could quite possibly have been a conservative. The last I heard, the concern about America’s place as a moral leader in the world cuts across party lines.
